By accessing or using WhatContact, creating an account, connecting a third-party service, or using any of our services, you acknowledge that you have read and accepted these Terms and understand the privacy practices described below.

1. Services
WhatContact provides software-based communication, customer interaction, messaging, integration, automation, customer management, and related digital services.
Certain features may depend on third-party platforms and services, including but not limited to Meta, WhatsApp, cloud infrastructure providers, telecommunications providers, payment providers, and other external APIs.
The availability and functionality of such third-party services may be subject to their own terms, policies, technical limitations, and service availability.
2. Account and User Responsibilities
Users are responsible for:
- Providing accurate and up-to-date account information.
- Maintaining the confidentiality and security of their account credentials.
- Ensuring that their use of WhatContact complies with applicable laws and regulations.
- Obtaining any legally required consent from customers, contacts, or other individuals before processing their personal data or sending communications.
- Complying with the policies and terms of third-party platforms integrated with WhatContact, including Meta and WhatsApp policies where applicable.
Users may not use WhatContact for unlawful, fraudulent, abusive, misleading, unsolicited, or unauthorized activities.
3. Subscriptions and Payments
Certain WhatContact services may be offered on a paid subscription basis.
Subscription fees, billing periods, payment terms, and included services are displayed during the purchasing process or specified in the relevant quotation, agreement, or invoice.
Unless otherwise stated, invoices must be paid within the period specified on the invoice.
Where recurring billing is enabled and authorized by the customer, subscription payments may be automatically charged using the customer's registered payment method.
Failure to complete payment may result in the restriction, suspension, or termination of paid services.
Applicable taxes and legally required charges are the responsibility of the user unless otherwise required by applicable law.
4. Cancellation and Termination
Users may cancel their subscription in accordance with the cancellation conditions applicable to their subscription plan.
Cancellation prevents future subscription renewals unless otherwise specified.
Fees already paid are non-refundable unless a refund is required by applicable law or expressly agreed otherwise.
WhatContact reserves the right to suspend or terminate access to the service where:
- Payments remain overdue.
- The service is used unlawfully or abusively.
- The user violates these Terms.
- The user's activity creates a security, technical, legal, or reputational risk.
- Continued provision of the service would violate applicable laws or third-party platform requirements.
5. Third-Party Platforms and Integrations
WhatContact may integrate with third-party services, including Meta and WhatsApp.
These services are operated independently from WhatContact.
Changes, restrictions, interruptions, account suspensions, API limitations, policy changes, pricing changes, or service discontinuations implemented by third-party providers may affect the operation of WhatContact.
WhatContact cannot guarantee the uninterrupted availability of third-party services.
Users are responsible for complying with the applicable terms and policies of third-party platforms connected to their WhatContact account.
6. Availability of the Service
WhatContact will use commercially reasonable efforts to maintain the availability, security, and performance of the service.
However, uninterrupted or error-free operation cannot be guaranteed.
Temporary interruptions may occur because of:
- Scheduled or emergency maintenance.
- Software updates.
- Security requirements.
- Internet or telecommunications failures.
- Cloud infrastructure failures.
- Third-party service interruptions.
- API changes.
- Force majeure events.
- Circumstances outside our reasonable control.
8. Intellectual Property
All intellectual property rights relating to the WhatContact software, platform, website, interfaces, designs, trademarks, software code, documentation, and related materials belong to their respective rights holders.
Purchasing or using WhatContact does not transfer ownership of these intellectual property rights to the user.
Users are granted a limited, non-exclusive, non-transferable right to use the service during the applicable subscription or service period.
Users may not copy, reproduce, reverse engineer, resell, sublicense, or commercially exploit WhatContact except where expressly authorized in writing.
9. Limitation of Liability
To the maximum extent permitted by applicable law, WhatContact shall not be liable for indirect, incidental, consequential, or special damages resulting from the use or inability to use the service.
WhatContact is not responsible for losses resulting from:
- Third-party service interruptions.
- Meta or WhatsApp account restrictions or suspensions.
- Changes to third-party APIs or policies.
- Incorrect or unauthorized use of the platform.
- Communications sent by users.
- Actions taken by users or their authorized personnel.
- Loss of access caused by circumstances outside our reasonable control.
Nothing in these Terms excludes or limits liability where such exclusion or limitation is prohibited by applicable law.
10. Prohibited Use
WhatContact must not be used for:
- Spam or unauthorized unsolicited communications.
- Fraudulent or misleading activities.
- Harassment, threats, or unlawful content.
- Unauthorized collection or processing of personal data.
- Circumvention of Meta, WhatsApp, or other third-party platform policies.

11. Changes to the Service and Terms

Continued use of WhatContact following the effective date of updated Terms constitutes acceptance of the updated Terms to the extent permitted by applicable law.
12. Force Majeure
WhatContact shall not be responsible for delays or failures resulting from circumstances beyond its reasonable control, including natural disasters, governmental actions, internet or telecommunications failures, cyber incidents, infrastructure failures, third-party service outages, war, civil disturbance, or similar events.
13. Governing Law
These Terms and Conditions shall be governed by and interpreted in accordance with the laws of the Republic of Türkiye.
Any disputes arising from these Terms or the use of WhatContact shall be subject to the competent courts and enforcement offices of Türkiye, subject to mandatory provisions of applicable law.

- Connecting Meta, WhatsApp, and other third-party services.
